This Personal Information Privacy Policy (the "Policy") applies to the collection, use, processing, and disclosure of your Personal Information by AKEMI (referred to as "we," "us," or "our") through:

1. Our website and webstore, akemihome.com/my/ (the "Site").

2. The AKEMI Mobile Application (the "App"), including its function for controlling and operating the AI Mattress.

By providing your Personal Information to us, accessing the Site, or using the App, you confirm that you have read and understood this Policy and consent to the processing of your Personal Information in accordance with this Policy and the Malaysian Personal Data Protection Act 2010 ("PDPA").

 

2. Information We Collect

We collect information that relates directly or indirectly to you ("Personal Information"). This includes:

Transaction Data Details about payments to and from you, and other details of products or services you have purchased from us.
Technical & Usage Data Internet Protocol (IP) address, browser type/version, pages accessed, timestamp, error logs, and data collected via cookies (see Section 5).
App-Specific Connection Data Device Bluetooth state, nearby Wi-Fi network names (SSIDs), and precise or approximate location data for scanning purposes (see Section 4).
Sensitive Personal Data Data pertaining to physical or mental health, as defined by the PDPA (e.g., specific health-related settings or usage patterns from the AI Mattress, if applicable).

 

3. How We Use Your Information

We collect and process your Personal Information for the following purposes:

• To provide and promote our services and products.

• To complete transactions when you purchase products or services.

• To manage your registration for accounts, events, contests, or promotions.

• To communicate with you regarding your orders, services, and inquiries.

• To improve the performance and security of our Site and App.

• To display personalised advertisements and send you marketing communications about our products and services (with your consent, where required).

• To comply with our legal obligations under applicable laws and to cooperate with public and government authorities.

 

4. Specific App Permissions and Data Use (Google Play Requirement)

This section specifically addresses how the AKEMI Mobile Application uses device permissions to operate the AI Mattress.

A. Justification for Device Permissions

To ensure full functionality of the AI Mattress, the App requires the following device permissions. This data is strictly used to support the functions mentioned and is not used for any other purpose.

Permission Purpose
Bluetooth To scan for, pair with, and maintain a connection to the AI Mattress hardware.
Wi-Fi To scan nearby Wi-Fi networks and assist in the initial configuration of the mattress's network connection.

B. Prominent Disclosure for Location Data

We draw your attention to the use of Location permission, which is required by the Android operating system.

Due to technical requirements of the Android operating system, scanning for Bluetooth and Wi-Fi devices (including your AI Mattress) often requires the App to request Location Permission (either Precise or Approximate).

What we use Location for: The location permission is used solely to enable the underlying Bluetooth and Wi-Fi scanning functions needed to find and connect to your AI Mattress.

What we DO NOT use Location for: We DO NOT use this data to track your physical location, map your movements, or provide location-based services outside of connecting to the AI Mattress.

Data Sharing: Any collected location data used for scanning is kept private and will NOT be shared, sold, or rented to any third parties.

Note on Withdrawal: You may withdraw this permission at any time via your device settings, but this may prevent the App from connecting to and controlling your AI Mattress, making the device unusable.

 

5. Log Data and Use of Cookies

When you visit our Site or use our App, we automatically log certain information for statistical and diagnostic purposes (Log Data).

We use "cookies" and similar tracking technologies to enhance your experience. A cookie is a small data file that our Site stores on your device. We use this data to:

• Understand how you use our Site.

• Provide you with content based on your preferences.

• Manage and improve user experience.

All data collected through cookies is primarily technical and usage data and is not used to personally identify users on its own. You have the right to accept or decline cookies by modifying your browser settings, but please note that some features on the Site may not function properly if you refuse cookies.

7. International Transfers of Personal Information

Your Personal Information may be processed, transferred, and stored in Malaysia and/or in other countries by third parties or our affiliates. These countries may not provide the same level of data protection as your home jurisdiction.

By using our Site and App, you expressly consent to us transferring your Personal Information outside of Malaysia. We will take reasonable steps to ensure that any international transfers are done in accordance with the requirements of the PDPA and that your data remains confidential and secure.

 

8. Data Security and Retention

We are committed to protecting your Personal Information. We implement appropriate technical, physical, electronic, and procedural security measures to safeguard against unauthorized access, disclosure, or processing of your data.

We will keep your Personal Information for as long as necessary to fulfil the purpose for which it was collected. If your Personal Information is no longer required, we will delete it from our servers or anonymize it, unless retention is necessary to comply with operational, legal, regulatory, tax, or accounting requirements.

 

9. Your Rights and Controlling Your Personal Information

In accordance with the PDPA, you have the right to:

Access: Request a copy of the Personal Information we hold about you.

Correction: Request us to correct any Personal Information about you that is inaccurate, incomplete, or out of date.

Withdraw Consent/Limit Processing: Request us to limit the processing and use of your Personal Information (e.g., requesting us to stop sending you marketing and promotional materials).

We reserve the right to refuse requests for access or correction for reasons permitted under the law. We may impose a small fee (as permitted by the PDPA) to cover the administrative costs of processing your access request.

 

10. Children's Privacy

Our products and services are not directed at anyone under the age of 13. We do not knowingly collect personal identifiable information from children under 13. If we become aware that we have collected Personal Information from a child under 13, we will take immediate steps to delete this information.

 

11. Changes to this Privacy Policy

We reserve the right to modify, update, and/or amend this Policy from time to time with reasonable prior notice to you. We will notify you of any amendments via announcements on the Site, within the App, or by other appropriate means. Your continued use of the services after being notified of any amendments constitutes your agreement to and acceptance of those amendments.
